Property Distribution (equitable Distribution)

Florida follows equitable distribution principles for marital property. In distributing the marital assets and liabilities between the parties, the Court must begin with the premise that the distribution should be equal between the married couple. However, if the Court finds that there is a reason or a justification for an unequal distribution based upon several factors that can be considered, than an unequal distribution can and must be considered.

In proceeding for dissolution of marriage, the Court may grant alimony to either party. Florida's alimony framework provides Courts with flexibility to award different types of support based on the circumstances of each case. In 2023, Florida Law no longer allowed Permanent Alimony and established presumptions that a Court can consider, with a number of years for short-term marriages, moderate-term marriages, and long-term marriages. This now gives parties a framework and an easier understanding in figuring out the number of years of alimony what they may be awarded should their case go to Court.
